Terms of Use | Unpuffed

Unpuffed is not medical care and not an emergency service. It's a self-help tool for tracking your quit and getting through cravings. It doesn't diagnose, treat or cure anything. Talk to a doctor or pharmacist about quitting, including nicotine replacement and other options. If you're in crisis or thinking about harming yourself, call or text 988 (U.S.), or call 911 in an emergency.

1. Who can use Unpuffed

You must be at least 18 years old. You're responsible for using the app in line with the laws where you live.

2. Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use Unpuffed on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, resell or redistribute the app, except where the law allows it regardless of this restriction.

3. Health information

The app's timeline shares general information from public health sources (such as the National Cancer Institute, Smokefree.gov and the CDC), each cited in the app. It's general education, may not apply to you, and isn't a promise of any result. Everyone's quit is different. Money-saved figures are estimates based on what you enter.

4. Unpuffed Plus

Unpuffed's core features are free. Unpuffed Plus is an optional upgrade, sold through Apple's App Store:

Subscriptions (yearly or monthly) renew automatically at the price shown when you subscribed, unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged within 24 hours before each renewal.
Free trial: if offered, a trial converts to a paid yearly subscription at the end of the trial unless you cancel at least 24 hours before it ends. The trial length and price are shown before you start.
Lifetime is a one-time purchase of Plus with no renewals.
Managing and canceling: in iPhone Settings → your name → Subscriptions, or from the You tab in the app. Deleting the app doesn't cancel a subscription.
Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. We can't issue refunds directly.
Prices may change; a change won't apply to a subscription period you've already paid for, and Apple will notify you as its rules require.

Features included in Plus may change over time. If we remove a Plus feature, we'll aim to replace it with one of similar value.

5. Your information

What you log stays on your device, encrypted, as described in our Privacy Policy. Because we don't hold a copy, we can't recover it for you. Keep your device backed up if you want to keep your history. "Delete all data" in the app is permanent.

6. Acceptable use

Don't use Unpuffed to break the law, to harm others, or to interfere with the app or the services it relies on. Share cards are yours to share; please don't alter them to misrepresent the app.

7. Disclaimers

Unpuffed is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the app will be uninterrupted or error-free, or that it will help you quit.

8. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of Unpuffed. Our total liability for any claim relating to the app is limited to the amount you paid for Unpuffed Plus in the 12 months before the claim, or $50 if you paid nothing. Some places don't allow these limits, so they may not apply to you.

9. Apple

These terms are between you and The Dev Side only, not Apple Inc. ("Apple"). In addition:

Responsibility. The Dev Side, not Apple, is solely responsible for Unpuffed and its content.
Maintenance and support. The Dev Side is solely responsible for any maintenance and support for the app. Apple has no obligation to provide maintenance or support services.
Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are The Dev Side's responsibility, subject to these terms.
Product claims. The Dev Side, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
Intellectual property. If a third party claims that the app or your possession and use of it infringes that party's intellectual property rights, The Dev Side, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Third-party terms. You must comply with applicable third-party terms (such as your wireless carrier's) when using the app.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms, and on your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

10. Ending these terms

You can stop using Unpuffed at any time by deleting it (and canceling any subscription). We may suspend or end your license if you seriously break these terms. Sections 3, 5, 7, 8, 9 and 11 continue to apply afterwards.

11. Law and disputes

These terms are governed by the laws of the State of South Dakota, U.S.A., without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in South Dakota, unless the law where you live gives you the right to bring it elsewhere. If any part of these terms is unenforceable, the rest still applies.

12. Changes

We may update these terms. We'll change the date at the top, and for significant changes we'll let you know in the app. Continuing to use Unpuffed after a change means you accept the updated terms.
